OFFICIAL CONTEST RULES: 24 HOURS AND THE HOBBIT: AN UNEXPECTED JOURNEY CONTEST
NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN THIS CONTEST. ODDS OF WINNING WILL DEPEND ON THE TOTAL NUMBER OF ENTRIES RECEIVED. DECLARATION OF ELIGIBILITY/RELEASE OF LIABILITY/PRIZE ACCEPTANCE AGREEMENT MAY BE REQUIRED.
THE CONTEST RULES ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITIES TO THE SPONSOR FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.
ELIGIBILITY: You must be eighteen (19) years of age and a legal resident of Canada at time of entry. Employees of 24 Hours Vancouver (the “Sponsor”), Warner Bros. Pictures Canada, and each of their respective parents, affiliates, subsidiaries, advertising sponsors, prize suppliers, promotional partners and promotional agencies, and the immediate family members of each are not eligible to enter or win. The Contest begins 12:00am on Tuesday, November 20, 2012 and closes on Tuesday, December 4, 2012 at noon (the "Contest Period"). One (1) valid entry per contestant. No purchase is necessary to enter the Contest. This Contest is void where prohibited by law.
HOW TO ENTER. You will require a UPICKEM username and password. If you do not have a Upickem account, you can register for free by visiting www.vancouver.24hrs.ca/contests clicking on the ‘Register Now’ button, and completing the form. Once registered, you can login to enter for a chance to win. To enter the Contest, fill out and submit the online entry form located on the Contest site at www.vancouver.24hrs.ca/contests
PRIZES:
Grand Prize. There is one (1) grand prize (“Grand Prize”) available to be won by the Grand Prize winner (the “Grand Prize Winner”) consisting of: one (1) trip for two (2) people to travel cross-Canada with VIA Rail. The Grand Prize shall include:
Round trip for two (2) (the Grand Prize Winner and one (1) “Guest”) by train in Business, Sleeper or Sleeper Plus classes between any two (2) stations within the VIA Rail network. Subject to availability of space.
The Grand Prize will not exceed eleven thousand dollars ($11, 000.00). Actual value of Grand Prize will depend on departure and destination cities and timing of travel.
Grand Prize Winner is not entitled to monetary difference between actual Grand Prize value and stated approximate Grand Prize value, if any.
Travel must be redeemed and completed no later than December 16, 2013.
Grand Prize Winner and his/her Guest’s travel will be determined upon winner selection and confirmation. Should the Grand Prize Winner and/or Guest be unable to travel on the dates and times designated by the Sponsor, the Grand Prize will be forfeited and awarded to an alternate winner. Grand Prize Winner and Guest will be responsible for (without limitation) transportation to and from any train terminal and/or train station (including originating and departing airport if applicable), any local transportation costs, any local hotel accommodations, travel and medical insurance, travel documentation, airport improvement fees, taxes, gratuities, telephone calls, in-room charges, meals and alcoholic and non-alcoholic beverages and any other expense not explicitly included in the Grand Prize.
Secondary Prizes: There are fifteen (15) secondary prizes (“Secondary Prizes”) available to be won by the Secondary Prize winner(s) (“Secondary Prize Winner(s)”). Each Secondary Prize includes two (2) Canadian premiere screening tickets to THE HOBBIT: AN UNEXPECTED JOURNEY, on or about Wednesday, December 12, 2012 in Vancouver, British Columbia. The address of the premiere screening will be provided by Sponsor within a reasonable time prior to the premiere screening. The Secondary Prize Winners and each of their companions are advised to arrive at least one (1) hour prior to the premiere screening start time. No one will be admitted without a ticket or after the premiere screening begins. Unused tickets cannot be refunded or exchanged. The value of each Secondary Prize is $30.00
The Grand Prize and Secondary Prizes must be accepted as awarded and cannot be transferred, assigned, substituted or redeemed for cash, except at the sole discretion of the Sponsor. Any unused portion of the Grand Prize will be forfeited and have no cash value. The Sponsor reserves the right, in its sole discretion, to substitute a prize of equal or greater value if the Grand Prize (or any portion thereof) and/or the Secondary Prizes cannot be awarded for any reason.
Value based on full peak adult fares as of November 2012.
ODDS-OF-WINNING: The odds of winning will depend on the total number of entries received during the Contest Period.
WINNER SELECTION:
a. A random draw will be held on Tuesday, December 4, 2012 at the 24 Hours Vancouver office located at 554 East 15th Avenue, Vancouver, BC at approximately 1:00pm, Pacific Standard Time. The potential Grand Prize Winner will be selected from all eligible entries received during the Contest Period. The selected entrant will be contacted on December 5, 2012 and follow the instructions to claim his/her prize.
b. Before being declared the Grand Prize Winner, the selected entrant will be required to correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question by phone call, and be required to comply with all the Contest Rules and to sign such Declaration and Release forms as required by the Sponsor, and the Guest of the Grand Prize Winner will be required to sign such Declaration and Release forms as required by the Sponsor.
c. Upon notification, the potential winner must respond within 24 hours of being contacted or within the time period specified by the Sponsor representative. If the potential winner does not respond in accordance with the Contest Rules or the potential winner does not comply with the Contest Rules, he/she will be disqualified and will not receive the Grand Prize and another potential winner may be selected. Sponsor is not responsible for the failure for any reason whatsoever of a potential winner to receive notification or of Sponsor to receive potential winner’s response. The Grand Prize is not transferable or convertible to cash and must be accepted as awarded.
d. Grand Prize Winner will be required to sign an agreement and release confirming compliance with the Contest Rules and acceptance of the Grand Prize as offered, and
(i) releasing, discharging, holding harmless and indemnifying the Sponsor, Warner Bros. Pictures Canada, VIA Rail Canada Inc. and each of their respective parent companies, subsidiaries, affiliates, employees, directors, officers, suppliers, agents, sponsors and administrators from any and all liability for any loss, harm, damages, cost or expense arising out of participation in this Contest or participating in any prize-related activity or the acceptance, use or misuse of any prize, including without limitation costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, and from any and all claims of third parties arising therefrom; and
(ii) granting Sponsor the unrestricted rights, in its individual discretion, to publish without any further compensation the name, picture, portrait, likeness, voice and ideas of that entrant for advertising and promotional purposes. The agreement and release must be returned within two (2) business days of the notification date.
GENERAL CONDITIONS:
Automated entries of any kind are not allowed. Detection of said automated entries will lead to entries being voided.
Only one registered UPICKEM account per entrant. If multiple accounts are detected for a single entrant, they will be disabled and entries disqualified.
Contest entrants agree to abide by the terms of these Contest Rules and by the decisions of the Sponsor, which are final on all matters pertaining to the Contest, subject to any decision of the Régie des alcools, des courses et des jeux du Québec, with respect to any question within its jurisdiction.
The Contest is governed by the laws of Ontario and the laws of Canada applicable therein, and is subject to all applicable federal, provincial and municipal regulations.
Sponsor reserves the right to use any and all information related to the Contest, including information on contestants obtained through the Contest, for marketing purposes or any other purpose, unless prohibited by law.
The Contest and all of the related pages, contents and code are copyright, UPICKEM, and/or 24 Hours Vancouver. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.
Each entrant, by participating in the Contest, agrees to release, discharge, hold harmless, and indemnify the Sponsor, Warner Bros. Pictures Canada, VIA Rail Canada Inc. and each of their respective parent companies, subsidiaries, affiliates, employees, directors, officers, suppliers, agents, sponsors and administrators from any and all liability for any loss, harm, damages, cost or expense arising out of participation in this Contest or participating in any prize-related activity or the acceptance, use or misuse of any prize, including without limitation costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, and from any and all claims of third parties arising therefrom.
Sponsor and administrators are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of entries in the Contest. Sponsor and administrators assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor and administrators are not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, e-mail, players, or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing. Sponsor and administrators are not responsible for any injury or damage to entrants or to any computer related to or resulting from participating or downloading materials in this Contest. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor and administrators which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest, subject to the approval of the Régie des alcools, des courses et des jeux du Québec, if required.
UPICKEM and Sponsor are not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God.
For Quebec residents, any litigation respecting the conduct or organisation of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie for the purpose of helping the parties reach a settlement.
All results posted are unofficial until the winner responds to e-mail notification.
This Contest is not intended for gambling. If it is determined that a contestant is using the Contest for gambling purposes he/she will be disqualified and reported to authorities.
Sponsor reserves the right to change the Contest Rules at any time, subject to the approval of the Régie des alcools, des courses et des jeux du Québec, if required.
This Contest is officially sponsored by 24 Hours Vancouver.
Warner Bros. Pictures Canada, VIA Rail Canada Inc., and their respective parents, affiliates and subsidiaries are not responsible for the promotion, administration or execution of this Contest.
